General Terms and Conditions (GTC) of The Family Circle GmbH

1. GENERAL

The following General Terms and Conditions (“GTC”) apply to all ticket and marketplace sales by The Family Circle GmbH, Wilhelms Allee 15, 22587 Hamburg (“Organizer”).

2. TICKET ORDERS

Tickets can – subject to availability – be ordered for events, workshops, or lectures organized by the Organizer.

A ticket grants admission to the event for one person on the event day for which the ticket was purchased. Children under the age of 3 accompanied by an adult ticket holder are admitted free of charge.

The stated ticket price is due immediately, and the payment method provided by the attendee will be charged directly after the ordering process. The GTC can be accessed at any time by the attendee at https://www.thefamilycircle.de/de/agb. Payments are processed via the payment provider Mollie Payments.

In the event of official regulations (e.g., COVID-related measures), the Organizer reserves the right to impose time restrictions on attendees. Should special regulations for events apply at the time of the event, all ticket holders will be informed in good time.

3. WORKSHOP PARTICIPATION

Workshop slots are offered separately once the schedule is published online. One person may participate per booked workshop, including one accompanying person (e.g., 1 adult with 1 child or 1 child with 1 adult). Tickets are personal and generally non-transferable. Participants must be present 5 minutes before the workshop begins. If a participant who has booked a workshop is not present at the start, the Organizer has the right to assign the spot to someone else.

4. TRANSFER/EXPIRATION OF TICKETS

Tickets are personal and generally non-transferable. Participants with reserved workshops in combination with a valid ticket must be present 5 minutes before the workshop begins. If a participant is not present when the workshop starts, the Organizer may assign the spot to someone else (see §3).

5. RIGHT OF WITHDRAWAL

5a. EXCHANGES & RETURNS IN THE TFC MARKETPLACE

Exchange and return policies vary between TFC Marketplace vendors and can be found in the respective Vendor Info sections. When purchasing items from the TFC Marketplace, you are entitled to a statutory right of withdrawal.

5b. “EVENTS”

Ticket returns / Event cancellation or postponement

Purchased tickets are excluded from return and exchange. Cancellations by the participant or the Organizer cannot be made. This also applies in the case of illness, no-shows, or other reasons. A return is only possible if the event is canceled or unreasonably postponed. A postponement is considered unreasonable if the new date or location is not acceptable to the visitor, taking into account their legitimate interests. This does not apply if the cancellation or postponement is due to force majeure (see §6).

The Organizer will announce any cancellation or postponement immediately on their website. In the event of cancellation or unreasonable postponement, the Organizer will refund the ticket price. Announcements regarding exhibitors, speakers, and topics are non-binding and may be changed at any time.

According to § 312g para. 1, para. 2 no. 9 BGB, the attendee has no statutory right of withdrawal, even if purchasing tickets as a consumer rather than a business.

6. FORCE MAJEURE

If the event cannot take place or is postponed due to circumstances beyond the Organizer’s control – such as force majeure or equivalent events (e.g., national mourning, weather conditions, strikes, war) – the Organizer shall not be liable for any resulting losses or damages. In such cases, tickets will not be refunded.

7. EVENT ENTRY

Attendees must present a valid ticket at the entrance without being asked. Since tickets are personal, attendees may also be required to present valid government-issued photo ID. Upon admission, the attendee will receive a non-transferable badge (e.g., event badge or wristband), which must be worn at all times during the event, especially to re-enter the venue after leaving.

To ensure a safe and pleasant experience for all attendees, the Organizer reserves the right to deny entry to individuals who appear aggressive, disruptive, or under the influence of substances. Weapons or dangerous objects are not permitted on the premises.

8. HOUSE RULES

The Organizer exercises domiciliary rights at the event. All instructions from the Organizer must be followed. The venue’s house rules must be observed while on the premises. Violations of the house rules or unauthorized marketing activities may lead to exclusion from the event and removal from the premises. The Organizer reserves the right to assert further claims.

9. GENERAL LIMITATION OF LIABILITY

The Organizer is liable without limitation for damages caused intentionally or by gross negligence, as well as for injuries to life, body, or health. The same applies in the event of breach of warranty or fraudulent concealment of defects.

Otherwise, the Organizer shall not be liable for damages caused by simple negligence. This does not apply in the case of a breach of a fundamental contractual obligation, i.e., a duty essential for the proper execution of the contract and on which the attendee regularly relies. In such cases, liability is limited to foreseeable, typical damages.

Liability under the Product Liability Act remains unaffected.

These limitations of liability also apply to the personal liability of the Organizer’s agents, assistants, and legal representatives.

10. SPECIAL LIABILITY LIMITATION FOR CLOAKROOM

If the Organizer offers a free cloakroom service for items such as coats, jackets, suitcases, or bags, the following conditions apply:

  • Visitors must not deposit valuables (e.g., laptops, smartphones, jewelry), data carriers with confidential and/or business information, payment cards, or travel tickets.
  • The Organizer is only liable for damage or loss of items if caused by intentional or grossly negligent conduct by the Organizer or its agents.
  • Liability is limited to a maximum of €500 per visitor.

11. DATA PROTECTION

The Organizer processes and uses personal data only for the purpose of handling ticket orders and organizing the event. For workshop reservations, first and last names may be shared with the respective workshop speaker for organizational purposes. Further details can be found in our [Privacy Policy].

If the attendee has consented, their data may also be used for marketing purposes or passed on to third parties (e.g., exhibitors). The attendee may revoke this consent at any time by contacting the Organizer (e.g., via email to hallo@thefamilycircle.de).

12. LEGAL WARRANTY AND OTHER REGULATIONS

12a. The statutory warranty applies.

12b. Use of the services available on thefamilycircle.de is permitted for individuals aged 18 and older.

12c. The contract text of these GTC is not saved by us. You can view these GTC on thefamilycircle.de. You may also save or print this document using your internet browser (usually “File” -> “Save As” or “Print”).

12d. The exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Hamburg, provided the contracting party is a merchant.

12e. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers residing outside of Germany may also rely on the laws of the country in which they reside.
